An organization called the Ukrainian Congress Committee of America submitted a filing with the Federal Communications Commission (FCC) asking the agency to use its official powers to go after Elon Musk, based on their view that he is not doing enough to help Ukraine. Their filing asks the FCC to require Musk to step down from Starlink, to stop processing Starlink applications altogether, and ultimately to revoke SpaceX’s FCC licenses. Their submission is chock full of sweeping and unmoored allegations about “illegal meddling in US foreign policy” in Ukraine and complaints about the ways in which Starlink connectivity has been provided within Ukraine. Their submission is both procedurally improper and substantively meritless. Indeed, their filing repeatedly invokes laws and rules that have no application here. Plainly, this filing should have never left the drafts folder. The FCC must make clear that this agency will no longer participate in these efforts. The FCC should dismiss this filing with prejudice, lest the agency’s silence invite even more attempts just like it.

New Data Confirm Internet Isn't Broken

When the Federal Communications Commission ended the Obama Administration’s failed, two-year experiment with these heavy-handed regulations back in 2017, Title II advocates guaranteed that doing so would literally break the Internet. They claimed that broadband prices would spike, that you would be charged for each website you visited, and that the Internet itself would slow down. None of this was true. Broadband speeds increased, prices decreased, competition intensified, and years of record-breaking infrastructure builds brought millions across the digital divide. Here is the latest data:

Median fixed download speeds in the U.S. have increased by more than five-fold or approximately 430% since 2017, according to Ookla data.
Median mobile download speeds have increased by more than seven-fold or approximately 647% since 2017, according to Ookla data.
The United States has leapfrogged other countries since 2017 and now ranks among the highest in the world for fixed, mobile, and 5G broadband speeds, according to Ookla data.
In real terms, the prices for Internet services have dropped by about 9% since the beginning of 2018.
On the mobile broadband side alone, real prices have dropped by roughly 18% since 2017.
And for the most popular broadband speed tiers, real prices are down 54%, and for the fastest broadband speed tiers, prices are down 55%, over the past 8 years.
In the four years following the 2017 Title II repeal, the percentage of Americans with access to two or more high-speed, fixed ISPs increased by about 30%—up from 229 million to approximately 295 million, according to FCC measures.
Entirely new players and forms competition have also emerged since 2017, including a new generation of high-speed LEO satellite services plus fixed wireless and 5G offerings.
In 2022, broadband builders laid over 400,000 route miles of fiber, a more than 50% increase over 2016 numbers. In 2023, fiber was stretched to 9 million new U.S. households, setting a new all-time record for fiber-to-the-home deployments in a single year.
The number of outdoor small cell nodes has increased by over four-fold from 100,000 in 2017 to 466,850 by year end 2023, according to industry data.
Record breaking buildout was supported in part by record breaking new investment. In 2022, the broadband industry invested a record $102.4 billion in U.S. communications infrastructure, which represents a 21-year high for investment and a 19% year-over-year increase, according to industry data.

The Federal Communications Commission will vote on April 25 to further expand the government’s power over the Internet. It will do so by implementing President Biden’s call for the FCC to impose utility-style “net neutrality” regulations on the Internet through Title II of the Communications Act of 1934. This decision follows the five-member FCC’s partisan, 3-2 vote last October to seek public comment on this action. And it comes on the heels of President Biden’s demand that the FCC give the Administrative State new controls over the Internet through “digital equity” rules, which the agency did last November through a party-line vote. All of these steps are part of the Biden Administration’s plan for expanding government control of the Internet. I oppose President Biden’s plan. The American people want more freedom on the Internet—not freewheeling micromanagement by government bureaucrats.

Arpan Sura has joined Commissioner Brendan Carr's office as Legal Advisor. Sura previously served as Senior Counsel to the Chief of the FCC’s Wireless Telecommunications Bureau, where he focused on spectrum policy, emerging technologies, and infrastructure matters. Before joining the FCC, Sura spent more than a decade representing clients in the telecommunications and technology sectors, most recently as Counsel in the Communications, Internet, and Media practice at Hogan Lovells.

In October 2023, the Biden Administration called on the Federal Communications Commission to implement provisions of the Infrastructure Investment and Jobs Act. The FCC will vote on Nov 15 on new rules; I oppose the plan for several reasons:

President Biden’s plan hands the Administrative State effective control of all Internet services and infrastructure in the country.
President Biden’s plan sweeps entire industries within the FCC’s jurisdiction for the first time in the agency’s 90-year history.
President Biden’s plan allows the FCC to impose unfunded build mandates on ISPs and unlimited monetary fines on every covered entity.
President Biden’s plan includes price controls.
President Biden’s plan adopts an expansive and disfavored theory of liability that Congress neither directed nor authorized the FCC to adopt.

The Federal Communications Commission will begin implementing President Biden’s plan for increasing government control of the Internet. There will be lots of talk about “net neutrality” and virtually none about the core issue before the agency: namely, whether the FCC should claim for itself the freewheeling power to micromanage nearly every aspect of how the Internet functions—from the services that consumers can access to the prices that can be charged. The entire debate over whether Title II regulations are necessary or justified was settled years ago. Indeed, when my FCC colleagues and I voted in 2017 to overturn the Obama Administration’s failed, two-year experiment with Title II, activists and politicians alike guaranteed the American public that the Internet would quite literally break without it. They predicted that prices for broadband would spike, that you would be charged for each website you wanted to visit, and that the Internet itself would slow down. Did any one of those predictions come to pass? Of course not

Biden Administration Blames Private Sector for Failed Government Policies

The Biden Administration’s broadband policies are failing. The costs for building out Internet infrastructure in this country have skyrocketed thanks to inflationary policies under their watch. The Federal Communications Commission is sitting on spectrum that could connect millions of Americans to new, high-speed services. The Administration has needlessly blocked and delayed new broadband infrastructure builds. Fiber and cell site components are laying fallow in warehouses across the country due to the government’s failure to remove regulatory red tape. Permitting reform has gone nowhere. They are preparing to waste billions of taxpayer dollars by spending it without a national coordinating strategy. The list goes on. Now, the Biden Administration has announced that it will blame the private sector for the outcomes of these failed government policies. Instead, the Administration should reverse course and unleash America’s private sector to build, connect, and invest.

FCC Commissioner Carr Warns Against Following Europe's Lead on Internet Controls

Europe’s utility-style regulations, which have nothing at all to do with net neutrality, would be a serious mistake. The proof can be seen in the data. Just compare networks in the US to those in Europe:

US networks are faster than in every single country in Europe, as Ookla’s fixed, median download speed rankings show.
US networks are more competitive than those in Europe, with the US having a nearly two-fold or 40 percentage point lead (87% to 45%) when it comes to households with access to two or more wired, facilities-based providers.
US networks bridge the digital divide more so than those in Europe, with the US leading Europe by 11 percentage points (98% to 87%) when it comes to households with high-speed, fixed broadband, and by an even larger, 31 percent (91% to 60%) in rural areas.
US 5G networks cover 95% of the American population compared to just 72% in Europe, according to European Union officials.
US networks are benefiting from providers here investing three-fold more per household than their European counterparts.

FCC Commissioner Carr Announces Staff Changes

Federal Communications Commissioner Brendan Carr announced that Lauren Garry has joined his office as Legal Advisor. Lauren joins Commissioner Carr’s office from the Wireline Competition Bureau, Telecommunications Access Policy Division, where she focused on the High-Cost Program, including the Connect America Fund and the Rural Digital Opportunity Fund. Garry also served as the Designated Federal Officer for the Precision Agriculture Connectivity Task Force. Before entering the FCC through the Attorney Honors Program, Garry was a Law Clerk to the Honorable William Colwell in the Office of Administrative Law Judges at the Department of Labor. She has also worked for Comcast Corporation, the U.S. Senate, and the House of Representatives. Garry received her J.D. cum laude and M.B.A. from American University and has an undergraduate degree from Bowdoin College. Commissioner Carr also thanked Danielle Thumann, who served as his Legal Advisor since 2021, for her public service.
